LLIBERTAT PER A HAMZA YALÇIN: QUE RES NO ENS FACI CÒMPLICES DEL RÈGIM DICTATORIAL DE RECEP TAYYIP ERDOGAN

L’escriptor i periodista suec d’origen turc Hamza Yalçin va ser detingut, el proppassat dia 3 d’agost, a l’aeroport del Prat, i des d’aleshores està empresonat a Can Brians. La policia espanyola el va detenir executant una ordre de recerca dictada per Recep Tayyip Erdogan, que acusava l’escriptor de pertànyer a una organització terrorista, la qual no existeix, i d’injuriar el president turc a través d’algun dels seus articles. El passat 24 d’agost l’Audiència Nacional va desestimar la petició de llibertat de Hamza fins a la resolució de la causa d’extradició.

Les organitzacions i entitats sotasignats, profundament sorpreses i preocupades per la detenció i empresonament de Hamza, demanem el seu alliberament immediat i la no extradició pels motius que ressenyem:

— Hamza Yalçin és un periodista de llarga i fructífera trajectòria, que va haver d’abandonar Turquia per la seva lluita en defensa dels drets civils i polítics. Va ser perseguit per la seva militància i ideologia, i va obtenir l’asil polític i la nacionalitat sueca. Ara és perseguit fora del seu país per exercir la seva feina: explicar la realitat de Turquia, on cada vegada hi ha menys drets i menys garanties per a la població que no combrega amb el règim d’Erdogan. Com amb tots els professionals del periodisme i de l’escriptura, cal garantir sempre el seu dret a la llibertat ideològica i d’expressió. Així com també cal preservar la llibertat de premsa i el dret a la informació de tots els ciutadans. Quan un periodista no es pot expressar lliurement, és tota la societat qui hi surt perdent.

— Entenem que aquesta detenció s’emmarca dins la campanya repressiva del president turc Erdogan que, sobretot des del cop estat fallit de juliol de 2016, ha empresonat jutges, advocats, fiscals, membres d’organitzacions en defensa dels Drets Humans, periodistes i escriptors sota falses acusacions de terrorisme, amb el propòsit d’emmudir aquelles veus incòmodes per al seu govern. I continua exercint la repressió sobre tots aquells estaments que no contribueixin al missatge que ell dicta. En aquest sentit, un dels col·lectius més perjudicats ha estat el de la premsa i els professionals de la informació, els quals han vist com han empresonat més de dos centenars de periodistes en poc temps, que estan a l’espera de judicis que mai no arriben. També han assistit al tancament continu de mitjans de comunicació, sota l’emparament legal de la legislació antiterrorista. L’altre col·lectiu que ha patit aquesta repressió ha estat el dels professors. Avui són milers els empresonats a Turquia de manera arbitrària i sense cap garantia, esperant judici. Turquia ha estat definida pel també periodista turc Can Dündar com “la presó més gran d’Europa”.

— Ens preocupa que l’estat espanyol estigui assumint el paper de còmplice en la repressió de la premsa lliure i en l’empresonament de les veus dissidents envers el règim turc. És greu que un estat democràtic pugui estar jugant una perillosa complicitat amb les autoritats turques, executant una ordre de la Interpol que no tenia obligació d’executar. Altres estats europeus no han fet cas de les peticions de Turquia i s’han negant a col·laborar amb les seves autoritats en l’empresonament i repressió a la dissidència política.

— Volem denunciar la manca d’independència del Ministeri Fiscal, el qual hauria de vetllar pel rigorós compliment dels Drets Humans i no sota criteris polítics i corporatius. La seva representació no ha posat en evidència els greus perills que subsisteixen en el present procediment tant per a Hamza Yalçin com per a la llibertat de premsa i d’expressió. En tot moment ha tingut un paper absolutament contrari a la llibertat de Hamza, mantenint l’ingrés a presó fins a la resolució de l’extradició i oposant-se sistemàticament a la petició de llibertat feta per la defensa.

— Sol·licitem, per tant, a l’Audiència Nacional, que actuï de forma independent als interessos polítics del govern espanyol i vetlli per l’estricte respecte als Drets Humans, acordant la immediata posada en llibertat de Yalçin i denegant-ne l’extradició.

— Així mateix demanem que el govern de l’estat espanyol, de qui depèn en darrera instància la resolució de l’extradició de Yalçin, denegui l’extradició del periodista suec, amb un clar i inequívoc compromís en la defensa dels Drets Humans, drets que Turquia vulnera sistemàticament.

— Finalment, cal recordar que Hamza Yalçin és ciutadà europeu, que va tenir la condició de refugiat polític l’any 1987, fins que va aconseguir la nacionalitat sueca el 2006. La protecció internacional brindada per Suècia va respondre al fet d’haver estat una persona perseguida al seu país d’origen per les seves idees i la seva lluita política i haver estat torturat durant el període de captiveri a Turquia, així com haver estat condemnat a mort a Turquia.

— Demanem a les autoritats espanyoles que de cap manera contemplin la possibilitat d’extradir-lo a Turquia. En primer lloc perquè no s’escau, ja que les acusacions es fonamenten en falses atribucions emmarcades en una campanya de repressió a la premsa lliure. Acceptar com a certa la farsa judicial iniciada per les autoritats de Turquia, representaria establir un greu precedent per a aquelles persones que han escollit les lletres per lluitar per la llibertat en els seus països d’origen. Totes aquelles persones que volen explicar el món a través de la paraula, les quals es veuen obligades a buscar refugi en els nostres països. En segon lloc, perquè no hi ha cap mena de garantia que la seva integritat física i moral sigui respectada. Turquia ha suspès l’aplicació del Conveni Europeu dels Drets Humans i existeixen denúncies de múltiples organismes internacionals sobre l’existència de tortures i execucions extrajudicials. Havent estat Yalçin condemnat a mort a Turquia, res no garanteix que les seves autoritats no executin aquesta condemna, ja que l’executiu turc s’està replantejant restaurar la pena de mort.

Per tot l’exposat, demanem l’alliberament immediat i sense condicions de Hamza Yalçin, i la denegació d’extradició a Turquia, així com el cessament immediat del col·laboracionisme de l’estat espanyol amb el Govern Turc, mancat de garanties democràtiques i de respecte als Drets Humans.

May we be in no way complicit with the dictatorial regime of Recep Tayyip Erdogan

Hamza Yalçin, the Swedish writer and journalist of Turkish origin, was arrested the 3rd of August past, in the El Prat Airport, and since then he has been imprisoned in Can Brians prison (Barcelona). The Spanish police arrested him executing an arrest warrant issued by Recep Tayyip Erdogan, which accused the writer of belonging to a terrorist organization, which does not exist, and of slandering the Turkish president in some of his articles. On the 24th of August the Spanish National High Court dismissed Hamza’s petition for freedom pending resolution of the extradition case.

The undersigned organizations and entities, profoundly surprised and concerned by the arrest and imprisonment of Hamza, demand his immediate freedom and non-extradition for the reason indicated:

— Hamza Yalçin is a journalist with a long and fruitful history, who had to abandon Turkey because of his struggle in defense of civil and political rights. He was persecuted for his militancy and ideology, and obtained political asylum and Swedish nationality. Now he is being pursued outside of his country for doing his job: explaining the reality of Turkey, where there are consistently fewer rights and guarantees for the population that does not subscribe the Erdogan regime. As occurs with all journalistic and writing professionals, their right to freedom of expression and ideology must always be guaranteed. Just as freedom of the press and the right to information of all citizens must be preserved. When a journalist cannot express himself or herself freely, all society suffers a loss.

— We understand that this arrest is framed within the repressive campaign of Turkish president Erdogan who, in particular since the failed coup d’état of July 2016, has imprisoned judges, lawyers, district attorneys, members of Human Rights organizations, journalists and writers under false accusations of terrorism, for the purpose of silencing voices that discomfit his government. And he continues to exercise repression upon any organization or class of organizations that do not contribute to the message he imposes. In this regard, one of the most affected collectives has been the press and communications professionals, who have seen how more than two hundred journalists have been imprisoned in a short time, and are awaiting trials that never take place. They have also witnessed the continual closing of media outlets, under the legal protection of anti-terrorist legislation. Nowadays thousands are in prison in Turkey for arbitrary reasons and without guarantees, as they await trial. Turkey has been defined by another Turkish journalist, Can Dündar, as “the biggest prison in Europe.”

— We are concerned that the Spanish State is taking on a complicit role in the repression of the free press and in the imprisoning of voices dissident with the Turkish regime. It is a grave issue that a democratic state should be applying a dangerous complicity with the Turkish authorities, executing an order from Interpol that it was not under obligation to execute. Other European states have not heeded the Turkish requests and have refused to collaborate with their authorities in the imprisonment and repression of political dissidence.

— We decry the lack of independence of the Office of the Attorney General, which should be safeguarding rigorous compliance with Human Rights and not acting under political and corporative criteria. Its representatives have not called out the grave dangers that underlie the current proceedings both for Hamza Yalçin and for freedom of press and expression. At every state it has had a role entirely contrary to Hamza’s freedom, maintaining his ingress to prison until resolution of the extradition and systematically opposing the request for release presented by the defense.

— We demand, therefore, that the National High Court act independently of the political interests of the Spanish government and act to ensure the strict respect of Human Rights, stipulating the immediate release of Hamza Yalçin and rejecting his extradition.

— In addition, we demand that the Spanish government, on which the resolution of the extradition of Hamza Yalçin ultimately depends, deny the extradition of the Swedish journalist, with a clear and unequivocal commitment to the defense of Human Rights, rights that Turkey is systematically violating.

— Finally, it must be recalled that Hamza Yalçin is a European citizen, who was accorded the condition of political refugee in 1987, until he received Swedish nationality in 2006. The international protection offered by Sweden responded to the fact of have been a person persecuted for his ideas and his political struggle in his country of origin and having been tortured while in captivity in Turkey, as well as having been condemned to death in Turkey.

— We demand that the Spanish authorities under no circumstances contemplate the possibility of extraditing him to Turkey. In the first place because it is unfitting, as the accusations are based on false accusations in the framework of a campaign of repression of the free press. To accept as valid the judicial farce originated by the Turkish authorities would be to establish a grave precedent for all persons who have chosen to write in their struggle for freedom in their countries of origin. Any person who seeks to explain the world through words, who find themselves forces to seek refuge in our countries. In the second place, because there is no guarantee that their physical and moral integrity will be respected. Turkey has suspended the application of the European Convention on Human Rights and there are accusations from many international organizations regarding the existence of tortures and extra-judicial executions. As Hamza Yalçin has been condemned to death in Turkey, nothing guarantees that the Turkish authorities will not carry out this sentence, since the Turkish executive is reconsidering restoration of the death penalty.

For all the above reasons, we demand the immediate freedom without conditions of Hamza Yalçin, and the denial of his extradition to Turkey, as well as the immediate ceasing of collaboration of the Spanish State with the Turkish Government, which is lacking in democratic guarantees and respect for Human Rights.
